I am no fan of the Obamacare legislation but let's at least be accurate about it. This is not a real estate tax, it is a Medicare tax that potentially applies to investment income, including real estate sales. For real estate sales, the seller has to meet an adjusted gross income threshhold of at least $200K (single) or $250K (married). Then, the tax only applies to TAXABLE GAIN, not the sales price. Since there is a $500K exclusion on the gain in selling a home, a seller would have to have made a profit of at least $500K in addition to being a higher earner. Whether hitting the wealthy is the right approach or not, this Medicare tax will hit very few transactions.
